1. Agreement to terms
These Terms and Conditions govern your access to vitaltidesusa.com and your purchase of products from Vital Tides Research LLC. (“Vital Tides”, “we”, “us”). By using this site or placing an order you agree to be bound by these terms. If you do not agree, do not use this site.
2. Research use only
Vital Tides supplies research-grade materials intended exclusively for laboratory research. All products are not for human or animal consumption, not for clinical or diagnostic use, and not for any application that would violate local, state or federal law. No product sold on this site has been evaluated or approved by the U.S. Food and Drug Administration or any comparable authority. Nothing on this site is intended to diagnose, treat, cure or prevent any disease.
3. Regulatory status
Vital Tides Research LLC. is a chemical supplier. Vital Tides is not a compounding pharmacy or chemical compounding facility as defined under Section 503A of the Federal Food, Drug, and Cosmetic Act. Vital Tides is not an outsourcing facility as defined under Section 503B of that Act. We do not dispense prescription drugs and we do not provide medical advice.
4. Eligibility and buyer representations
You must be at least 18 years of age to purchase from this site. By placing an order you represent and warrant that:
- you are a qualified researcher, laboratory or organisation familiar with the safe handling of research chemicals;
- you are purchasing solely for laboratory research;
- you will not administer any product to yourself, another person or any animal;
- you will not resell, relabel or redistribute any product for human or veterinary use;
- you are responsible for compliance with all laws governing purchase, possession, handling, use and disposal in your jurisdiction;
- you hold any licence, registration or institutional approval your work requires.
5. Orders, pricing and availability
All prices are shown in U.S. dollars and may change without notice. Product availability is not guaranteed. We make reasonable efforts to keep product information accurate but do not warrant that descriptions, specifications, pricing or availability are complete or error-free, and we may correct errors at any time. We may refuse, limit or cancel any order at our sole discretion, including where misuse or lack of qualification is suspected. Where we cancel an order you have paid for, we will refund it in full.
6. Payment
Payment in full is required before dispatch. Accepted methods are those displayed at checkout, currently ACH bank transfer and Venmo. By selecting ACH, you authorise Vital Tides Research LLC. to initiate a single electronic debit from the bank account you designate for the order total, and you represent that you are an authorised signer on that account. This authorisation applies only to the order in question; returned or reversed payments may result in cancellation of the order and any applicable bank fees. Taxes and any applicable fees are the responsibility of the purchaser.
7. Title and risk of loss
Title and risk of loss pass to you when the carrier accepts the shipment. Shipping terms, claim windows and delivery conditions are set out in our Shipping Policy.
8. Returns
Returns, replacements and cancellations are governed by our Refund and Returns Policy, which forms part of these terms.
9. Acceptable use of this site
You agree to use this site only for lawful purposes. You may not attempt to interfere with the site or its systems, gain unauthorised access, scrape or harvest content or data, introduce malicious code, or conduct fraudulent activity. You may view and download material for personal research reference only.
10. Intellectual property
All content on this site, including text, product data, graphics, photography, logos and software, is owned by or licensed to Vital Tides Research LLC. and protected by intellectual property law. Reproduction, redistribution or modification without our written consent is prohibited.
11. Third-party links
This site may link to third-party websites for reference. We do not control and are not responsible for their content, products or privacy practices. Visiting them is at your own risk.
12. Disclaimer of warranties
Products and this site are provided on an as-is and as-available basis. To the fullest extent permitted by law, Vital Tides disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.
13. Limitation of liability
To the fullest extent permitted by law, Vital Tides, its owners, officers, employees and affiliates will not be liable for any indirect, incidental, special, punitive or consequential damages, or for any loss arising from misuse of a product or use inconsistent with its research-only designation. Our aggregate liability for any claim is limited to the amount you paid for the product giving rise to the claim.
14. Indemnification
You agree to indemnify and hold harmless Vital Tides, its owners, officers, employees and affiliates from any claim, loss, liability or expense arising from your purchase, handling, storage, use or disposal of any product, or from your breach of these terms.
15. Accessibility

16. Governing law and disputes
These terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute will be brought exclusively in the state or federal courts located in San Diego County, California.
17. Changes to these terms
We may revise these terms at any time. The version published at the time of your order governs that order.
